SENTENCING SET FOR DECEMBER FOR TENNESSEE MAN IN CONNECTION TO FATAL CRASH

A Tennessee man is facing sentencing in December after his conviction on two charges relating to the deaths of a Missouri family during a drunk driving incident.

Dunklin County Prosecuting Attorney Nicholas Jain tells KWOC News, that 59 year old Benny Johnson, of Milan, Tennessee was convicted by a Stoddard County Jury on Wednesday for three charges of driving while intoxicated causing a death and two charges of leaving the scene of a motor vehicle accident.

The charges stem from the deaths of 32 year old Tiffini Santana and two children from Butler, Missouri, who were killed in July of 2017 when Johnson struck them with his truck.

Laboratory analysis revealed Johnson’s blood alcohol content to be in excess of the legal limit hours after the crash.

Jain says that the jury returned a sentencing recommendation of 10 years in the Missouri Department of Corrections on each of the three DWIs and 4 years each on the two charges of leaving the scene of an accident, as well as a fine, which is the maximum possible sentence under the law.

A sentencing hearing has been scheduled for December 1st.

TODAY IS BUCKLE UP, PHONE DOWN DAY IN MISSOURI

Missourians are being encouraged to drive safely today for Buckle Up, Phone Down day.

Governor Mike Parson has proclaimed October 22nd as Buckle Up, Phone Down Day in Missouri in an effort to encourage Missourians to take two simple actions to save lives on the state’s highways – fasten their seat belts and put their phones down while driving.

Missouri’s 2021 Seat Belt Usage Survey showed 88 percent of vehicle occupants use a seat belt, matching the highest rate the state has ever recorded.

But the unbuckled 12 percent make up a majority of the state’s roadway fatalities, which spiked in 2020 despite a decrease in traffic volume. More than two-thirds of the drivers and passengers killed in traffic crashes last year were not wearing a seat belt.
