But now, attorney Chuck Hatfield has revised that request to instead ask the judge to send the measure back to the Legislature for a new summary. He contends it would violate the constitution's separation of powers for a judge to rewrite a legislative measure.

Hatfield is representing a gun-control activist and the St. Louis police chief.

Referring the measure back to lawmakers could knock it off the ballot, because they aren't in session. EPA REGULATIONS UNDER FIRE FROM MISSOURI GOVERNMENT

The legislation is an attempt to prevent Missouri from helping implement a proposed rule change by the federal Environmental Protection Agency. That proposal would give manufactures five years to meet tougher standards reducing emissions from wood stoves by an estimated 80 percent.

The EPA's existing regulations date to 1988 and don't apply to all of the different kinds of wood-burning devices now in use.

Missouri has been among a minority of states that still impose a lifetime ban on government food assistance for drug felonies.

The legislation also would temporarily suspend food stamp or welfare payments to anyone who has not used the electronic benefits in Missouri at least once in the past 90 days. That comes after a recent audit questioned the out-of-state use of welfare benefits.

Two teachers from the Francis Howell School District are the plaintiffs in the lawsuit, including one who serves as president of the local chapter of the National Education Association.

A Missouri judge has denied a request to stop election officials from distributing absentee ballots for a proposed constitutional amendment dealing with gun rights.

Beetem heard arguments Wednesday in the lawsuit brought by St. Louis Police Chief Samuel Dotson III and Rebecca Morgan, a member of the Missouri chapter of Moms Demand Action for Gun Sense in America.

Their lawsuit says the ballot summary written by legislators implies that it's establishing a right to bear arms that already exists. The lawsuit says the summary also fails to note that the measure would subject laws restricting gun rights to strict legal scrutiny.

UNEMPLOYMENT BENEFIT BILL VETOED BY GOVERNOR NIXON

Missouri Governor Jay Nixon has vetoed legislation that would have shortened the duration of unemployment benefits.

The bill rejected Tuesday by Nixon would have tied the length of jobless benefits to the state's unemployment rate.

Missouri residents currently can collect benefits for up to 20 weeks. The bill would have allowed that only when the state's average unemployment rate is at least 9 percent.

The maximum length of benefits would have decreased as unemployment rates dropped, bottoming out at 13 weeks when the jobless rate is less than 6 percent.

The legislation also would have raised the cap on how much money can be kept in Missouri's unemployment trust fund.

Nixon said the bill was unnecessary, because Missouri has now finished repaying a federal debt for its unemployment fund.

If Noranda's rates are reduced, the Missouri Public Service Commission could allow Ameren to charge more to residential customers to recoup the revenues.

LAWSUIT FILED REGARDING PROPOSED MISSOURI TRANSPORTATION SALES TAX

Opponents of a transportation sales tax on Missouri's August ballot are challenging the summary and cost estimate that voters will see.

A lawsuit filed Thursday by the Missouri Association for Social Welfare contends the ballot wording is misleading and unfair and should be rewritten.

Supporters of the ballot measure described the lawsuit as a long-shot attempt to make the wording more confusing.

The proposed constitutional amendment would impose a three-quarter-cent sales tax for roads, bridges and other transportation projects. Lawmakers who placed the measure on the ballot project it will generate $534 million annually for state and local governments over the next decade.

The lawsuit says the cost estimate is insufficient because it could be higher. It says the summary fails to note that the use tax also would rise.

Koster reported Tuesday on results of an investigation requested by lawmakers after consumers reported prices rising from less than $2 a gallon in December to more than $5 in January.

The report blames low supplies on a combination of factors, including record propane exports and high demand for propane to heat homes during an unusually cold and early winter. It also cites heavy use of propane to dry a record corn crop that was harvested later than normal.

Koster's office says it reviewed about 250 customer complaints about propane prices and interviewed 80 consumers. The office has been involved in mediating 75 cases and has recovered more than $3,000 for consumers.

WALGREENS STORES IN MISSOURI TO BE SUBJECT TO RANDOM PRICE CHECKS OVER THREE YEARS

An independent auditor will perform random price checks at Walgreen Co. stores around Missouri for the next three years under a legal agreement the company has reached with the state.

Missouri Attorney General Chris Koster announced Wednesday that Walgreen will pay for the audits and will be fined if the auditor finds discrepancies between advertised prices on Walgreen's merchandise and prices at the register.

Koster's announcement comes less than a year after Missouri filed a lawsuit in Jackson County court accusing the Chicago-based drugstore chain of overcharging customers and using deceptive pricing schemes. Walgreen has settled pricing practice lawsuits with California and Wisconsin.

Walgreen spokesman Jim Graham says the company is "pleased" to have reached an agreement that allows it "to continue to operate within our previously established business practices."

MISSOURI PRESIDENTIAL PRIMARIES MOVED BACK A MONTH TO MARCH

Missouri is moving its presidential primary back a month in an attempt to get in the good graces of the national Republican and Democratic parties.

Governor Jay Nixon signed legislation Wednesday that will set Missouri's 2016 presidential primary on March 15th instead of February 2nd.

The governor said the delayed primary should help Missouri comply with national party guidelines that could penalize states for holding primaries too early in the year.

Similar party guidelines led to a confusing situation for Missouri's 2012 presidential primary. The election was held in February.

But to avoid penalties from the national party, the state GOP decided to disregard the primary results and instead use a series of later caucus meetings to determine which candidates its delegates would support at the Republican National Convention.
